Case No. 4:25-CV-89-CLM
U.S. EQUAL EMPLOYMENT OPPORTUNITY COMMISSION Birmingham District Office

Welcome to the Website for the EEOC v. TCI of Alabama LLC Settlement

The United States Equal Employment Opportunity Commission (“EEOC”) is a federal agency that enforces laws that protect job applicants and employees from discrimination by employers based on their sex, race, religion, age, national origin, genetic information, disability, and pregnancy. The EEOC recently resolved its sex discrimination lawsuit against TCI of Alabama, LLC, on July 22, 2026, for $2.6 million. As described in the press release below, the EEOC alleged that from at least from 2006 through late 2022 TCI discriminated against a class of females by refusing to hire them for laborer positions because of their sex. If you received the Notice, it is because you have been identified as a potential class member and may be entitled to share in the settlement funds obtained by the EEOC.

The Consent Decree approved by the Court requires that TCI provide $2.6 million in monetary relief to eligible class members and implement significant changes in its practices that will help prevent future discrimination against female applicants at TCI.

If you received notice, you may be eligible to receive a portion of the Settlement Funds (1) if you are female and (2) you applied for laborer positions through one of several staffing agencies TCI utilized to hire laborers between August 1, 2020, and June 22, 2026, but (3) were not informed about available laborer positions at TCI. To confirm your eligibility, you must complete a questionnaire. You must complete the Questionnaire no later than January 1, 2027. Anyone who fails to complete and submit her responses to the Questionnaire by January 1, 2027 will not be entitled to monetary relief. If you have questions about the eligibility process or the Questionnaire, please contact the Claims Administrator, Simpluris.

Once you complete and submit your responses to the online Questionnaire, the EEOC will review to determine your eligibility. If you are eligible to receive a monetary award, the EEOC will notify you via email. This process will take some time, and you should not expect to receive notification of your eligibility for approximately two months after the deadline date. Checks will be mailed to the address you provide in your Questionnaire response.
